Kayak rental waiver and release

Read each section carefully. Every adult renter must sign for themselves before taking the equipment.

Rental availability: Kayak rentals are currently unavailable. Complete this waiver only when Fox & Maple has confirmed a rental with you.

Paddling risks and responsibility

I understand that kayaking and transporting, launching, and retrieving a kayak involve inherent risks, including cold water, changing weather, currents, submerged hazards, collisions, capsizing, drowning, wildlife, remote locations, and serious injury or death. I voluntarily accept these inherent risks and am responsible for choosing water, weather, and a route suitable for my ability.

I will not paddle while impaired. I will follow applicable laws, posted notices, manufacturer instructions, and any safety directions provided with the rental.

Customer-provided transportation

I understand that Fox & Maple does not transport the kayak. I am responsible for providing a suitable vehicle, racks or supports, and properly rated straps or tie-downs, and for loading, securing, transporting, and unloading the kayak safely and lawfully.

Any help offered with loading is a courtesy only. I remain responsible for checking the load and securing it before travel, during travel, and after any stop. To the fullest extent permitted by applicable law, Fox & Maple is not responsible for loss, damage, tickets, injury, or delay caused by customer-provided transportation or an improperly secured load.

Life vest, helmet, and equipment care

A life vest is included with the kayak and must be worn, correctly fitted and fastened, whenever I am on or near the water with the rented kayak. I will not use a damaged or incorrectly sized life vest and will contact Fox & Maple before launching if the supplied vest is unsuitable.

A paddling helmet is recommended, particularly in moving, shallow, rocky, or unfamiliar water, and may be requested as an optional rental subject to availability. A helmet reduces but does not eliminate risk.

I will inspect the kayak, paddle, life vest, and any other rented equipment before use, report existing damage before departure, use the equipment only as intended, and return all items in the condition received apart from ordinary wear. I understand that reasonable repair or replacement charges may apply to equipment that is lost or damaged while in my care.

Release

To the fullest extent permitted by applicable law, I release and hold harmless Fox & Maple RV Resort and its owners, employees, and agents from claims arising from the ordinary inherent risks of my voluntary rental and use of the equipment. Nothing in this waiver excludes liability that cannot lawfully be excluded.
